In the area of insolvency law, we provide legal services to both creditors and debtors.
For creditors, we prepare and file insolvency petitions and claims, including secured claims. We also represent creditors in creditor bodies and in the enforcement of liens in insolvency proceedings. We also have experience in assessing the contestability of a debtor’s legal actions and the return of special-purpose assets to the estate.
We provide debtors with legal advice in defending against so-called vexatious insolvency petitions. We provide services to debtors in bankruptcy or facing bankruptcy, consisting of the preparation of debtor insolvency petitions, petitions for a moratorium, petitions for reorganization, and the preparation of reorganization plans. We also have practical experience in preparing so-called pre-packaged reorganizations. We also provide debtors with comprehensive advice in insolvency proceedings concerning the administration of the business (enterprise) and the disposal of assets in accordance with the Insolvency Act. We also prepare proposals for debt relief for debtors.
We provide advice to members of the debtor’s statutory body in connection with their personal liability in the event of the bankruptcy of the legal entity they manage.
We represent debtors, creditors, and other persons in incidental disputes concerning the determination of claims, the exclusion of assets from the estate, and the determination of the ineffectiveness of an act.
